Who we are
This website, 23audio.com, is run by M. Oglesby, trading as 23audio ("23audio", "we", "us"). We are the controller of the personal information described here, which means we decide how it's used and are responsible for looking after it. We are registered with the UK Information Commissioner's Office (ICO) under registration number ZC258366.
Contact us about anything in this policy at hello@23audio.com.
The short version
- We only collect what you give us: when you buy a plugin, sign up for news, use the beta forms, or email us.
- We use it to deliver your licence, run the beta and answer you. We don't sell it, rent it or share it for anyone else's marketing.
- This site doesn't use tracking cookies, advertising or analytics.
- You can ask to see, correct or delete your information at any time.
What we collect, and why
If you buy a plugin
Orders are handled by our online reseller, Paddle.com, which is the merchant of record. Paddle collects your payment details and billing address and processes the payment; we never see your card details. Paddle handles that information under its own privacy policy.
Paddle tells us your name, email address, country, what you bought and the order number. We use these to send your licence code and download, to keep a record of which licence belongs to which order (so we can re-send a lost code, handle refunds and transfers, and switch off a licence that has been shared), and to send you service emails about plugins you own, such as updates.
We only send you news about new plugins or offers if you tick the box to say yes, and every such email lets you unsubscribe.
Legal basis: to carry out our contract with you (your licence), and our legal obligation to keep business records. News emails rely on your consent.
If you sign up for news
When you sign up for news at the bottom of any page, we collect your email address. We first send you one email asking you to confirm; you're only added to the list once you click the link in it.
We use your address to email you about new plugins, updates and offers. We send these through our email provider, Brevo, which also tells us whether an email was delivered, opened or clicked, so we can see which news is useful. Every email has an unsubscribe link, and unsubscribing takes you off the list straight away.
Legal basis: your consent, which you give by signing up and confirming. You can withdraw it at any time by unsubscribing or emailing us.
If you sign up for the beta
We collect your email address and, if you choose to give them, your name, the computer and DAW you use, which plugins interest you, the kind of work you do, and anything you write in the notes box.
We use this to decide who to invite to each beta (for example, making sure it's tested in Pro Tools on Windows as well as Logic on a Mac), to email you invitations, beta downloads and beta licences, and to follow up on your feedback.
Legal basis: your consent, which you give by ticking the box on the form. You can withdraw it at any time by emailing beta@23audio.com or replying to any beta email, and we'll stop emailing you about the beta.
If you send us a recording of your voice
If you tick the box on the beta report form, we may email you to ask for a short, unprocessed recording of your voice. We only use a recording once you've confirmed by email that we can: for before-and-after examples on our website and in our marketing (such as social media posts and videos), credited with your first name only.
Legal basis: your consent. You can withdraw it at any time by emailing beta@23audio.com: we'll take your recording off our website and out of our own channels, and stop using it in anything new.
If you send us a photo
If you tick the box on the beta report form, we may email you to ask for a photo of you using our plugin (your setup, booth or screen). We only use a photo once you've confirmed by email that we can: on our website and in our marketing (such as Instagram posts), credited with your first name, or tagged with the Instagram handle you gave us.
Legal basis: your consent. You can withdraw it at any time by emailing beta@23audio.com: we'll take your photo off our website and out of our own channels, and stop using it in anything new.
If you email us
We receive your email address, your name if it's included, and whatever you write, including any details about your computer or your purchase that you send to get help.
We use this to reply and to solve the problem you've raised.
Legal basis: our legitimate interest in answering questions and supporting our products. If you're a customer, it's also to carry out our contract with you.
When you visit the site
Like any website, our hosting provider automatically receives technical information when your browser requests a page: your IP address, browser type, the page requested and the time. This is used to deliver the site and to keep it secure, for example to spot and block abuse.
Legal basis: our legitimate interest in running a secure, working website.
Beta testing
Beta versions of our plugins don't send any information about you or your computer back to us. If you send us a bug report, it contains only what you choose to include.
Cookies
This site doesn't set any cookies and doesn't use analytics or advertising trackers, so there's nothing to accept or decline.
Some product pages may include a video from YouTube. We use YouTube's privacy-enhanced mode, which doesn't store cookies on your device until you press play. Once you play a video, YouTube's own privacy policy applies.
Who else handles your information
We use a small number of service providers to run 23audio. They process information only on our instructions, under contracts that require them to keep it secure:
- Paddle sells our plugins as our reseller and merchant of record, and processes payments.
- Netlify hosts this website and stores form submissions.
- Brevo (Sendinblue SAS, France) holds our news mailing list and sends our emails.
- Google Workspace provides our email, so it holds emails you send us and our replies.
We'll also share information if the law requires it, or to protect our rights or someone's safety.
International transfers
Brevo stores information in the European Union, which UK law recognises as giving adequate protection. Netlify and Google are based in the United States, so your information may be stored or processed there. Where that happens, it's protected by the safeguards UK data protection law requires, such as the UK Extension to the EU-US Data Privacy Framework, or the UK International Data Transfer Addendum to the standard contractual clauses.
How long we keep it
- Orders and licences: for as long as you own the licence, so we can support it, and at least 6 years after the order for tax and accounting records.
- News sign-ups: until you unsubscribe. If you never click the confirmation link, your address is not added to the list.
- Beta sign-ups: until you ask us to remove you or withdraw your consent, or 24 months after the last beta you took part in, whichever is sooner.
- Emails: for as long as needed to deal with your question, and then for up to 3 years so we can help if the same issue comes up again, unless you ask us to delete them sooner.
- Hosting logs: kept by Netlify for a short period, as set out in Netlify's privacy policy.
Your rights
Under UK data protection law you have the right to:
- see the personal information we hold about you;
- correct it if it's wrong or incomplete;
- delete it;
- restrict how we use it, or object to us using it;
- take a copy of it in a common format, to reuse elsewhere;
- withdraw your consent at any time, where we rely on it.
To use any of these rights, email hello@23audio.com. It's free, and we'll respond within one month.
If you're unhappy with how we've handled your information, please tell us first so we can put it right. You also have the right to complain to the UK Information Commissioner's Office: ico.org.uk/make-a-complaint, or 0303 123 1113.
Children
This site and the beta programme are not intended for children under 13, and we don't knowingly collect their information. If you think a child has given us their details, email us and we'll delete them.
Changes to this policy
We'll update this page when what we do with personal information changes. The date at the top shows when it was last changed. If a change significantly affects how we use information you've already given us, we'll tell you by email.
